The myQR.re service is operated by WinzUp, a SAS (simplified joint-stock company), registered with the Trade and Companies Register of Saint-Denis under number 101963593.

Any use of the service implies full and unreserved acceptance of these Terms of Use.

myQR.re is a platform designed to help businesses centralize their digital presence, publish a public page, manage links and QR Codes, nurture their customer relationships and run certain commercial operations from a single dashboard.

• subscriptions, wallet and credits.

Access to the dashboard requires the provision of credentials or an account associated with a business. Accounts may be created, activated or managed by the operator as part of the commercial operation of the platform.

• The business is responsible for the confidentiality of its credentials and for their use.
• It undertakes not to share its access beyond authorized persons within its organization.
• Any action carried out from the account is presumed to be performed under its responsibility, unless unauthorized access is promptly reported.

The accessible features depend in particular on the active plan, the account status, any trial phases, the available credits and the configured integrations.

• Certain features may be limited or unavailable depending on the active plan.
• The /go/ links and associated QR Codes may be activated or deactivated in accordance with the rules of the plan and the service.
• The digital menu, loyalty, events or special offers may require a higher subscription level.
• myQR.re may automatically apply the rights, restrictions, quotas and locks provided for by the active plan or by the account status.

The business remains responsible for the content, messages, offers, visuals, public information and settings it publishes via myQR.re.

• It warrants that it holds the necessary rights over the texts, images, logos, marketing content, QR Codes and offers published.
• It undertakes not to publish any unlawful, misleading, defamatory or infringing content, or content contrary to public order or the rights of third parties.
• It is responsible for the lawfulness of its commercial, promotional and relationship operations.
• It undertakes to use the service fairly, without seeking to circumvent its limitations, protections or rules of use.

The myQR.re email and SMS tools make it possible to segment contacts, prepare drafts, send campaigns or schedule sends. The user business remains responsible for complying with the regulations applicable to the prospecting and communications it sends.

• The business must have a valid legal basis to collect and use its contacts' data.
• It must respect objections, unsubscriptions, blacklists, invalid statuses and exclusion lists.
• Wallet credits, included quotas and technical limits may condition the actual sending of campaigns.
• Any abusive, fraudulent or bulk use, or use contrary to the rules of the sending providers, may result in suspension.

myQR.re may offer integrations with certain Google services, in particular for review and directions links, certain listing data and, where the business authorizes it, certain Google Business Profile features.

• These integrations are only enabled with the authorization of the user concerned.
• Google data is used solely to provide the features requested in the dashboard.
• The business can withdraw this access by disconnecting its Google account when this option is available.

The service may offer several plans (in particular Free, Pro and Premium), as well as manual activations, trials, quotas or consumable credits depending on the features used. Certain options may also be offered as a one-off purchase (for example unlocking advanced customization or a support pack).

• The actual rights depend on the active plan, the billing status and the rules of the service.
• Wallet credits may be used for certain operations, in particular marketing, depending on the modules enabled.
• Certain advanced features (for example generation by artificial intelligence) may be reserved for a higher plan such as Premium.
• Upgrading to a higher plan may take effect immediately, whereas downgrading to a lower plan may take effect at the end of the current period, in accordance with the applicable billing rules.
• The Pro plan trial exists in two forms: a 7-day trial with no bank card at the end of onboarding, or a first month free (about 30 days) by adding a bank card. The free month starts when the card is added: a business that began with the card-free trial can add its card at any time, including on the last day of that trial, and then benefits from a full free month that is added to the period already elapsed (the card-free trial days are not deducted).
• Trials or manual activations may end automatically at the scheduled expiry.
• In the event of non-payment, failed payment, expiry or end of the effective period, the account may be switched to a lower or limited plan in accordance with the platform's rules.

Payments are processed via Stripe.

• myQR.re does not store full bank card numbers.
• The service may retain non-sensitive data useful for the proper operation of subscriptions, top-ups and saved payment methods.
• Plan changes, cancellations, renewals, downgrades, credits or adjustments may depend on the statuses returned by Stripe.
• Invoices, payments and accounting operations remain subject to the applicable tax and accounting rules.

WinzUp strives to ensure reliable operation of the service, without guaranteeing permanent availability, the complete absence of errors or suitability for all particular uses.

• WinzUp is not responsible for the content published by user businesses.
• WinzUp cannot be held liable for indirect damages, loss of revenue, loss of opportunities, loss of data or damage to image arising from the use of the service, except where a mandatory legal provision provides otherwise.
• WinzUp's liability cannot be engaged in the event of force majeure, network malfunction, unavailability of third-party services or non-compliant use of the service.

WinzUp may suspend, limit or terminate all or part of access to the service in the event of non-payment, fraud, abusive use, breach of these Terms, a security threat, a request from a competent authority or technical necessity.

The business may end certain paid options in accordance with the terms provided in the dashboard or by the applicable billing system.

The elements making up myQR.re, in particular the architecture, code, interfaces, trademarks, logos, texts, graphics, databases, know-how and content specific to the platform, are protected by intellectual property law.

Except with prior written authorization, any unauthorized reproduction, adaptation, extraction, distribution, making available or reuse of all or part of the service is prohibited.

The processing of personal data carried out as part of the service is described in the Privacy Policy, which forms an integral part of the information provided to users of the service.

Certain features make it possible to generate or rework content (offers, events, menu, campaigns, myQR Copilote assistant) using artificial intelligence relying on a third-party provider (OpenAI). Their access may depend on the active plan.

• The generated content is provided as an aid and may contain errors or inaccuracies.
• The business remains solely responsible for checking the accuracy, lawfulness and compliance of the content before any publication or sending.
• The business undertakes not to submit sensitive data or unlawful content to these features.

The public site and public pages may use cookies and the Meta Pixel for operational, measurement and advertising purposes. Advertising measurement cookies are only enabled after the visitor's explicit consent, which can be withdrawn at any time.

These Terms of Use are governed by French law.

Failing an amicable resolution, any dispute relating to their interpretation, validity, performance or termination falls under the jurisdiction of the competent French courts, subject to the applicable mandatory rules.
