These General Terms of Sale govern the subscriptions, payments, credits and services offered by myQR.re.

Publisher and scope

The myQR.re service is operated by WinzUp, a SAS (simplified joint-stock company), registered with the Trade and Companies Register of Saint-Denis under number 101963593.

These Terms of Sale apply to any subscription or purchase made with myQR.re by a professional or, where applicable, a consumer.

Description of the service

myQR.re is a SaaS solution for managing a public professional page and associated tools from a dashboard.

  • public myQR.re page, customization and dedicated links;
  • QR Codes and redirections;
  • digital menu, loyalty, events, offers, bookings;
  • contacts, Email/SMS campaigns and statistics;
  • assistance and generation features powered by artificial intelligence;
  • subscription and credit wallet management.

The platform evolves over time. Certain features may be added, modified, suspended or made conditional on a specific plan.

Plans, modules and options

myQR.re mainly offers Free, Pro and Premium plans. The available modules depend on the active plan, the business rules and any options enabled. Certain advanced features (for example generation by artificial intelligence) may be reserved for the Premium plan.

  • The prices and features displayed on the site prevail as of the subscription date.
  • Certain options may be offered as a one-off purchase (single payment), for example unlocking advanced customization or a support pack.
  • Optional services (e.g. graphic design, physical materials, specific support) may be invoiced separately.

Subscription, duration and renewal

Unless stated otherwise, the subscription is monthly, with no minimum commitment, and renews automatically at each due date.

  • The subscription is linked to the business configured in the customer area.
  • Cancellation stops the next renewal and takes effect at the end of the period already paid for.
  • Any period that has begun remains payable, unless a mandatory legal provision provides otherwise.

Free trial

A free trial of the Pro plan may be offered depending on the current campaigns. Two trial formats coexist:

  • Trial without a bank card (7 days). At the end of onboarding, without adding a card, the business gets a 7-day Pro trial. At its end, with no active subscription, the account switches to the free plan.
  • Trial with a bank card (1 month free). By adding a bank card, the Pro subscription starts with a first free month (about 30 days), with no immediate payment.
  • Important point about when the free month starts. The first free month starts the moment the card is added, not when the account is created. A business that began with the 7-day card-free trial can add its card at any time, including on the last day of that trial: it then benefits from a full free month that is added to the period already elapsed (the card-free trial days are not deducted from the free month).
  • The trial temporarily unlocks Pro features with no immediate obligation to buy. The free month with a card can be cancelled at any time before it ends; without cancellation, the first charge at the Pro rate occurs at the end of the free period.
  • Only one trial of each type may be allowed per business, account or organization, unless otherwise agreed in writing.

Subscription and formation of the contract

The subscription is completed online from the myQR.re interfaces. The contract is deemed concluded upon validation of the corresponding payment or activation action.

  • The customer warrants the accuracy of the information provided.
  • myQR.re may refuse a subscription in the event of fraud, obvious anomaly, previous non-payment or unlawful use.

Prices and billing

Prices are displayed in euros, inclusive of all taxes where applicable. The invoice is issued in accordance with the tax rules in force and the billing identity provided by the customer.

myQR.re may change its prices. Any change applies for the future, from the next subscription, the next renewal or the next relevant transaction.

Stripe payments

Payments are processed via Stripe (subscriptions, one-off payments, wallet and saved payment methods).

  • The customer authorizes the recurring charges linked to their active subscription.
  • The customer remains responsible for the validity of their payment method.
  • Card data is managed by Stripe according to its own security and compliance standards.

Payment incident

In the event of a payment failure, automatic retries may be made. Failing regularization, access to the service may be limited or suspended.

  • restriction of certain features;
  • suspension of the public page;
  • deactivation of redirections or QR Codes;
  • blocking of wallet/top-up operations.

Suspension does not constitute a waiver of the sums due.

Wallet and credit top-ups

The wallet allows credits to be purchased for use in certain sends and marketing operations (in particular Email/SMS depending on the modules).

  • The wallet is an internal usage balance, not a bank deposit account.
  • Topping up the wallet is a separate operation from the subscription.
  • Except for a technical error attributable to myQR.re or a contrary legal obligation, a valid top-up is not refundable once the balance has been made available.
  • In the event of fraud, non-payment or chargeback, myQR.re may adjust, freeze or cancel the balance concerned.

Use of Email/SMS credits

Credits are consumed on actual sends according to the technical and pricing rules in force.

  • The announced volumes (e.g. included credits) apply within the scope of the active plan.
  • Unreachable contacts, operator rejections or anti-abuse limits may impact campaign results.
  • The customer is responsible for the legal basis, the consent and the content sent.
  • myQR.re may block or limit a non-compliant send (spam, fraud, impersonation, unlawful content).

Physical materials and additional services

Physical materials (stickers, posters, display stands, etc.) and services (design, setup, support) may be offered as extras.

  • These services are subject to a separate order/quote.
  • The materials remain the property of the customer after payment, but their usefulness may depend on an active subscription.
  • Delivery times are indicative and may vary according to logistical constraints.

Termination and end of service

The customer may cancel their subscription from the available interfaces or by contacting support.

  • Cancellation stops the automatic renewal at the next due date.
  • Afterwards, the paid features may be deactivated.
  • The data may be retained for a reasonable period and then deleted, subject to legal obligations.

Refunds and goodwill gestures

Refunds follow the applicable law and the commercial operations explicitly announced.

  • Subscriptions already consumed over a started period are in principle non-refundable, unless a legal provision provides otherwise.
  • Wallet credits already credited are non-refundable except for a technical error or a contrary legal obligation.
  • One-off purchases giving immediate access to a digital feature (e.g. unlocking advanced customization, a support pack) are performed upon validation and are, in principle, non-refundable once access is opened, except for a technical error or a contrary legal provision.
  • One-off commercial offers (e.g. satisfaction guaranteed or your money back) are applied according to their own conditions.

Customer obligations

The customer undertakes to use the service fairly and in compliance.

  • accuracy of account information;
  • compliance with applicable laws (consumer, advertising, GDPR);
  • no unlawful, misleading or defamatory content;
  • respect for the rights of third parties (trademarks, images, intellectual property).

Liability

myQR.re implements reasonable means to ensure the availability of the service, without any guarantee of a complete absence of interruption.

  • No liability in the event of network outages, unavailability of third-party services, maintenance or force majeure.
  • The customer remains responsible for their content, campaigns and uses.
  • Except for gross negligence or a mandatory legal provision, myQR.re's liability is limited to the amounts paid by the customer over the last 12 months.

Intellectual property

The myQR.re platform, its brand, its code, its interfaces, its graphic elements and its proprietary content remain the exclusive property of WinzUp.

The customer benefits from a non-exclusive, non-transferable right of use, strictly limited to the duration of their active service.

Data and compliance

The processing of personal data is detailed on the Privacy Policy page.

  • The customer is responsible for the legal basis of their campaigns.
  • myQR.re provides mechanisms for consent, unsubscription and contact management.
  • Advertising measurement cookies (Meta Pixel) are only enabled after the visitor's explicit consent, in accordance with the Privacy Policy.

Force majeure

Neither party may be held liable for a breach caused by an event of force majeure within the meaning of French law.

The affected obligations are suspended for the duration of the event. If the situation continues for a long time, either party may terminate the contract without compensation.

Governing law and disputes

These Terms of Sale are governed by French law.

In the event of a dispute, the parties will first seek an amicable solution. Failing that, jurisdiction is assigned to the competent French courts of the district of WinzUp's registered office, unless contrary rules of public policy apply.
